It’s been several months since Phaedra Parks filed for divorce from Apollo Nida but it appears the two are still going at it. According to Bossip, the Real Housewives of Atlanta star refuses to allow Apollo to drag her back and forth to court. For those who don’t know, this is actually considered Phaedra and Apollo’s second divorce because she reportedly filed last spring. Phaedra was granted a default judgment back in July after Apollo failed to respond to the divorce filing. So, now she’s dropping a legal bombshell on her estranged ex.
Not Here For It:
It has been reported that Phaedra is demanding Apollo pay for all legal expenses for this “second divorce” because she argues that his filing is a “frivolous” waste of time since a judge ruled on their divorce last year. However, Apollo is arguing a different perspective and wants the previous ruling disregarded.
Did Phaedra Use A Legal Loophole?:
For those who don’t know, there was a lot of chatter about Phaedra’s divorce filing because initially it couldn’t be found in the court system. Apparently, Phaedra filed under the last name “Nita” instead of “Nida.” Apollo argues that the filing wasn’t the result of a clerical error and the high-powered attorney’s deliberately filed this way to take advantage of the situation due to his incarceration. Since his name was misspelled, he was never notified about the hearing, which is why he never responded. His failure to respond made it easy for Phaedra to lock down the divorce without including him.
Could Phaedra have used the situation to her advantage? At this point, no one really knows. But, since she’s an attorney there’s a possibility she could have because she definitely knows the law and how to work the system. However, it doesn’t look like Apollo has plans to back down.
In addition to his request to have Phaedra’s ruling tossed out, Apollo is also seeking legal joint custody of their two sons, Aiden and Dylan. Despite Apollo’s incarceration, it doesn’t look like Phaedra will be getting rid of her ex anytime soon.
